How Blinker, Inc. collects, uses, shares, and protects information across the blinker.com website and the Blinker platform, and the privacy rights available to you.
This Privacy Policy explains how Blinker, Inc., a Colorado corporation with offices at 220 S. Wilcox St. #1300, Castle Rock, CO 80104 (“Blinker,” “we,” or “us”), handles information in connection with our website, our SaaS platform (BlinkerConnect), and our products — BlinkerProtect (protection / vehicle service contracts), BlinkerFinance (refinance), and BlinkerCover (insurance) (together, the “Services”). Please read Section 4 carefully: for much of the personal information processed through the platform, Blinker acts as a service provider on behalf of its business clients rather than as the party that decides how that information is used.
1.1 What this policy covers. This policy applies to information collected through the blinker.com website (the “Site”), through the Blinker platform, and through our products and related communications. It does not cover the privacy practices of our business clients or of third parties whose sites, products, or services you may reach through the Services.
1.2 Our clients. Blinker's clients (“Clients”) are businesses — primarily direct-to-consumer auto-warranty call centers — that use the platform to engage their own consumers, including prospects, leads, and customers (“Consumers”). Where a Client uses the platform to process Consumer information, that Client, and not Blinker, decides why and how the information is used. See Section 4.
2.1 Information you or Consumers provide. We (or Clients through the platform) may collect information you submit directly, such as name, contact details (phone, email, mailing address), vehicle information (year, make, model, mileage, VIN), information about an existing loan or coverage, and information needed to request a quote for a protection plan, refinance, or insurance product. When you contact us or request a demo, we collect the details you provide.
2.2 Information collected automatically. When you use the Site or platform, we and our providers may automatically collect device and usage data, such as IP address, browser and device type, pages viewed, referring pages, and interactions, using cookies and similar technologies (see Section 13).
2.3 Information from Clients and Partners. We may receive Consumer information from Clients who submit it to the platform, and information from Partners — such as product administrators, lenders, insurers, and payment processors — in the course of quoting, underwriting, fulfilling, or servicing a Product.
2.4 Call and message data. The platform may process telephone and text-message data, including phone numbers, call metadata, and, where a Client enables it, call recordings and message content. See Section 7.
3.1 To provide the Services. We use information to operate, maintain, and secure the Site and platform; to enable Clients to engage their Consumers; to facilitate quotes, applications, and enrollments for Products; and to route information to the relevant Partner.
3.2 To communicate. We use contact information to respond to inquiries, provide support, and send administrative and, where permitted, marketing communications about Blinker's own offerings. Client-directed outreach to Consumers is controlled by the Client, not by Blinker.
3.3 To improve and protect. We use information — including de-identified and aggregated data — to analyze usage, improve and develop the Services, prevent fraud and abuse, and maintain security.
3.4 To comply with law. We use information to meet legal, regulatory, and contractual obligations and to establish, exercise, or defend legal claims.
4.1 Where Blinker is a controller. Blinker acts as a controller (or “business”) for information collected for its own operational purposes — for example, information about visitors to the Site, prospective and current Clients, and personnel, and de-identified analytics used to run and improve the Services. This policy governs that processing.
4.2 Where Blinker is a service provider. For Consumer personal information that a Client submits to or generates through the platform, Blinker acts as a service provider / processor on the Client's behalf and processes that information under the Client's documented instructions and our Data Processing Addendum (DPA). In that role, the Client's own privacy notice — not this policy — governs how the information is used, and Consumers should direct privacy requests to the relevant Client. Blinker does not sell or share such Consumer information or use it for its own purposes except to provide the Services.
5.1 With Partners. To facilitate Products, we share relevant information with Partners — such as product administrators and obligors, lenders, insurance carriers and agencies, payment processors, and payment-plan providers — so they can quote, underwrite, fulfill, service, or pay out on a Product. Partners use that information under their own privacy practices.
5.2 With service providers. We share information with vendors that perform services for us — such as hosting, infrastructure, communications, analytics, and support — under contracts that limit their use of the information to providing services to us.
5.3 With Clients. Where we act as a service provider, we make Consumer information available to the applicable Client, which controls that information.
5.4 For legal and safety reasons. We may disclose information to comply with law, respond to lawful requests and legal process, enforce our agreements, and protect the rights, property, and safety of Blinker, our users, and the public.
5.5 In corporate transactions. We may disclose or transfer information in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.
5.6 We do not sell your information in the traditional sense. Blinker does not sell personal information for money. Certain data-sharing for advertising or analytics may be treated as a “sale” or “sharing” under some state laws; see Sections 8 and 9 for your rights.
6.1 Because our products relate to finance, insurance, and vehicle protection, some information we process may be “nonpublic personal information” under the Gramm-Leach-Bliley Act (GLBA) and its implementing rules. Where the GLBA applies, our and our Partners' handling of that information — and any GLBA privacy notice you receive — is governed by the GLBA and related financial-privacy laws, which may take precedence over parts of this policy for that information.
6.2 We limit the use and disclosure of financial information to what is needed to provide, service, and administer the relevant Product, to comply with law, and as otherwise permitted by the GLBA.
7.1 Client controls outreach. The platform enables Clients to call and message their Consumers. As between Blinker and the Client, the Client — not Blinker — determines who is contacted and is solely responsible for obtaining and maintaining all required consents and honoring opt-outs.
7.2 Consent and compliance. Client obligations for telephone and text outreach, including under the Telephone Consumer Protection Act (TCPA), Do-Not-Call rules, and call-recording laws, are set out in the Telemarketing & TCPA Compliance Addendum. Blinker processes call and message data as a service provider to enable the Client's permitted communications and does not use it for its own marketing.
8.1 Your rights. If you are a California resident and Blinker acts as a business for your information, you have the right to: (a) know and access the personal information we have collected; (b) delete your personal information; (c) correct inaccurate personal information; and (d) opt out of any “sale” or “sharing” of personal information. You also have the right not to receive discriminatory treatment for exercising these rights.
8.2 No sale in the traditional sense. Blinker does not sell personal information for money. To the extent any analytics or advertising cookies constitute “sharing” or a “sale” under the CCPA/CPRA, you may opt out using the controls described in Section 13 or by contacting us.
8.3 Service-provider data. Where Blinker processes Consumer information as a service provider for a Client, please direct CCPA/CPRA requests to that Client; we will assist the Client as required by the DPA.
8.4 How to exercise. Submit a request to support@blinker.com. We will verify your identity before responding and may use an authorized agent process consistent with law.
9.1 Residents of other U.S. states with comprehensive privacy laws (such as Colorado, Virginia, Connecticut, Texas, and others) may have similar rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, sale, and certain profiling.
9.2 To exercise these rights where Blinker is the controller, contact support@blinker.com. Where Blinker acts as a processor for a Client, direct your request to that Client. We will honor appeals of our decisions as required by applicable state law.
10.1 We retain personal information for as long as needed to provide the Services, comply with our legal, tax, and regulatory obligations, resolve disputes, and enforce our agreements. Where we process information as a service provider, retention is governed by the Client's instructions and the DPA.
10.2 When information is no longer needed, we delete or de-identify it in the ordinary course, subject to backup and legal-hold requirements.
11.1 We maintain administrative, technical, and organizational safeguards designed to protect personal information, including access controls, least-privilege access, and encryption of data in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12.1 The Services are intended for businesses and adults and are not directed to children. We do not knowingly collect personal information from anyone under 18, and never from children under 13. If we learn we have collected such information without appropriate authorization, we will delete it.
13.1 Cookies. We and our providers use cookies and similar technologies to operate the Site, remember preferences, measure performance, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect functionality.
13.2 Do-Not-Track. Because there is no common industry standard for “Do-Not-Track” signals, our Site does not currently respond to them. Where required by law, we treat recognized opt-out preference signals (such as Global Privacy Control) as a valid opt-out of “sale” or “sharing.”
14.1 Changes. We may update this policy from time to time. We will post the updated version with a new “Last updated” date and, where required, provide additional notice.
